Terms of Service

Please read these terms carefully. By using Product Planner, you agree to be bound by these terms, our Privacy Policy, and any additional guidelines we publish.

Last updated: October 16, 2026

1. Acceptance of Terms

Product Planner ("the Service") is provided by Empowered Technologies Sweden AB, Org.nr 559549-4500, Sweden ("we", "us"). By accessing or using the Service, you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organisation, you represent and warrant that you have the authority to bind that organisation to these Terms. If you do not agree, you may not use the Service.

2. Description of Service

Product Planner is a discovery-driven product management platform that helps teams organise their work using Opportunity Solution Trees, continuous discovery practices, and collaborative planning tools. The Service includes:

  • Workspace management with multi-tenant isolation.
  • Visual planning tools (Opportunity Solution Trees, boards, timelines).
  • Real-time collaboration features.
  • Integrations with third-party services (e.g. Azure DevOps).
  • AI-powered features for discovery assistance.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

3. User Accounts

You must create an account to use the Service. You agree to:

  • Provide accurate and complete registration information.
  • Maintain the confidentiality of your account credentials.
  • Notify us immediately of any unauthorised access or security breach.
  • Accept responsibility for all activities occurring under your account.

We reserve the right to suspend or terminate accounts that violate these Terms or remain inactive for more than 12 months.

4. Subscriptions & Billing

Plans: The Service is offered under free and paid subscription plans. Feature availability varies by plan. Pricing is published on our website and may change with 30 days' notice.

Billing cycle: Paid subscriptions are billed monthly in advance. You authorise us to charge your payment method on each renewal date.

Upgrades & downgrades: An upgrade takes effect immediately, and seats added mid-cycle are pro-rated for the rest of the period. A downgrade is a cancellation (see Termination) and takes effect at the end of the current billing period.

Refunds: Subscriptions are non-refundable, except where applicable law requires otherwise.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or to violate any applicable laws or regulations.
  • Attempt to gain unauthorised access to any part of the Service, other accounts, or connected systems.
  • Interfere with or disrupt the integrity or performance of the Service or its underlying infrastructure.
  • Reverse-engineer, decompile, or disassemble any part of the Service.
  • Use automated means (bots, scrapers) to access the Service without our prior written consent.
  • Upload content that infringes intellectual property rights or contains malware.

6. Intellectual Property

Product Planner and its original content (excluding user content), features, and functionality are owned by Empowered Technologies Sweden AB and are protected by international copyright, trademark, and other intellectual property laws. Our trademarks may not be used without prior written permission.

7. Your Content

Ownership: You retain all ownership rights to content you create within Product Planner, including opportunities, solutions, experiments, notes, and any other data you input.

License to us: You grant us a limited, non-exclusive, royalty-free license to host, store, display, and transmit your content solely to provide and operate the Service. This license terminates when you delete your content or close your account.

Data export: You can export your planning items to Azure DevOps at any time from within the Service. A complete copy of your workspace data in a machine-readable (JSON) format is available on request via privacy@product-planner.com or the contact form.

8. Service Level Agreement

For paid plans, we target 99.9% monthly uptime (measured excluding scheduled maintenance windows, which are announced at least 48 hours in advance). "Uptime" means the Service is available and materially functional.

If we fail to meet this target in any calendar month, affected customers may request a service credit equal to 5% of their monthly fee for each full 0.1% below the target, up to a maximum of 30% of that month's fee.

9. Termination

By you: You may cancel your subscription at any time in your organization's billing settings. Cancellation takes effect at the end of the current billing period. Your data remains accessible until the period ends.

By us: We may suspend or terminate your access immediately if you breach these Terms, engage in fraudulent activity, or fail to pay fees when due. We will make reasonable efforts to notify you before termination except in cases of serious violations.

Effect of termination: Upon termination, your right to use the Service ceases. We will retain your data for 90 days so you can request an export, after which it is permanently deleted.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Product Planner and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising from your use of or inability to use the Service.

Our total aggregate liability for any claims arising from these Terms or the Service shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) €100.

11. Indemnification

You agree to indemnify and hold harmless Product Planner, its affiliates, officers, and employees from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your infringement of any third-party rights.

12. Dispute Resolution

Informal resolution: Before filing a formal dispute, you agree to contact us and attempt to resolve the matter informally within 30 days.

Governing law: These Terms are governed by and construed in accordance with the laws of Sweden, without regard to conflict-of-law principles.

Jurisdiction: Any disputes that cannot be resolved informally shall be submitted to the exclusive jurisdiction of the courts located in Stockholm, Sweden.

13. Modifications to These Terms

We may update these Terms from time to time. Material changes will be communicated via email or in-app notification at least 30 days before taking effect. Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms. If you disagree, you may cancel your account before the changes take effect.

14. General Provisions

Entire agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Product Planner regarding the Service.

Severability: If any provision of these Terms is found unenforceable, the remaining provisions continue in full force and effect.

Waiver: Our failure to enforce any right or provision does not constitute a waiver of that right or provision.

Assignment: You may not assign your rights under these Terms without our consent. We may assign our rights in connection with a merger, acquisition, or sale of assets.
